On June 5, the People's Court of Hanoi, Vietnam, held an appeal hearing for the following defendants: Bui Huy Hoa (Aged 36), Pham Thi Hao (Aged 35), and Tran Thi Thu Trang (Aged 39).  In July 2024, the Thanh Tri District Court of Hanoi initially sentenced them for producing and trading counterfeit goods:

• Bui Huy Hoa: sentenced to 5 years in prison

• Pham Thi Hao and Tran Thi Thu Trang: each sentenced to 3 years in prison.

• Tran Van Thuy, the manager of Thuy Phat Company, was also sentenced to 3 years in prison on the same charge.

The first-instance judgment determined that Tran Van Thuy established Thuy Phat Company, responsible for its operation, management, procurement, and payment. Hoa served as the sales executive, responsible for selling products, finding clients, and sourcing products. Hao was the warehouse worker, inventorying goods in and out. In order to obtain high profits, Hoa participated in selling counterfeit Xingfa aluminum products and worked jointly with Tran Van Thuy to advance related matters. Hoa also sought assistance from a third party and requested the third party to affix counterfeit Xingfa aluminium trademarks on the goods.

As an employee of the third party, Trang involved in selling counterfeit Xingfa materials during business promotion. After obtaining approval from the leader, Trang carried out transactions at a specific price, and there also were records of fund transfers.

On May 30, 2023, Hoa and Hao were caught by law enforcement officers in Thanh Tri District, Hanoi City while they were delivering counterfeit Xingfa aluminium profiles. Upon inspection, a certain quantity of counterfeit Xingfa aluminium profiles were stored in the warehouse.

After the first instance, Hoa, Hao, and Trang all filed appeals. They claimed they were merely employees following their manager's instructions.
